Ferva Health, Inc. ("Ferva," "we," "us," or "our") provides a patient engagement platform used by fertility and IVF clinics and their patients (the "Services"), including our mobile application and web-based clinic portal. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights available to you.

This Policy applies to patients who use the Ferva app, clinic staff who use the Ferva clinic portal, and visitors to our websites. Please read it carefully. By creating an account or using the Services, you agree to the collection and use of information as described here.

Ferva handles reproductive and fertility-related health information, which is sensitive personal data under most privacy laws, including India's Digital Personal Data Protection Act, 2023 ("DPDP Act") and, where applicable, the U.S. Health Insurance Portability and Accountability Act ("HIPAA"). We designed this policy — and our underlying data practices — around that sensitivity.

1. Information We Collect

1.1 Information you provide directly

  • Account and identity information: name, email address, phone number, date of birth, and password.

  • Health and fertility information: IVF cycle data, treatment stage, medication schedules and adherence logs, appointment history, symptoms you log, and messages exchanged with your clinic through the app.

  • Clinic-provided information: your treating clinic may enter or update clinical information relevant to your care via the clinic portal.

  • Communications: messages you send to your clinic or to Ferva support, including via in-app chat, SMS, WhatsApp, or voice channels.

1.2 Information collected automatically

  • Device and usage data: device type, operating system, app version, IP address, and general usage/interaction data (e.g., screens viewed, features used, crash logs).

  • Push notification tokens, used to deliver medication reminders and appointment alerts.

1.3 Information from clinics and third parties

Because Ferva operates on a clinic-to-patient (B2B2C) model, your treating clinic may share clinical and contact information with us in order to set up and manage your account and care journey.

2. How We Use Information

We use personal information to:

  • Provide the core Services — cycle tracking, medication reminders, appointment management, and secure messaging between you and your clinic;

  • Facilitate communication via SMS, WhatsApp, and voice channels for appointment and medication reminders and support;

  • Maintain, secure, and improve the Services, including diagnosing technical issues;

  • Communicate with you about your account, including service updates and, where you've agreed to receive them, product updates;

  • Comply with applicable legal, regulatory, and contractual obligations; and

  • With your consent, support de-identified analytics and future AI-assisted features (see Section 6).

3. Legal Basis for Processing (India — DPDP Act)

Where the DPDP Act applies, we process personal data on the basis of your explicit, informed consent, collected at account creation and for any new purpose we introduce. You may withdraw consent at any time as described in Section 8, though this may limit our ability to provide certain features of the Services.

4. How We Share Information

We do not sell personal information. We share information only in the following circumstances:

4.1 With your treating clinic

Your clinical and cycle information is shared with the clinic providing your care, as this is the core function of the Services.

4.2 With service providers

We use a limited set of third-party vendors to operate the Services, each processing data only on our behalf and under contractual confidentiality and security obligations:

  • AWS: Application hosting and data storage

  • Twilio: SMS and WhatsApp messaging for reminders and notifications

  • Intercom: In-app and website support messaging

  • Edesy: Voice-based patient support

  • Firebase: App distribution and push notifications (pilot/testing phase)

4.3 Legal and safety reasons

We may disclose information if required by law, regulation, legal process, or governmental request, or where we believe disclosure is necessary to protect the rights, property, or safety of Ferva, our users, or others.

4.4 Business transfers

If Ferva is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to standard confidentiality protections and this Policy (or its successor).

5. AI-Assisted Features

Ferva is developing optional AI-assisted features (for example, tools to help clinic staff triage patient messages). As of this policy's effective date, these features are not yet live in the app. When they are introduced:

  • Patient data is de-identified before being processed by any AI/LLM provider, wherever feasible for the feature in question;

  • We will update this Policy in advance of launch to describe the specific data flows involved; and

  • Any use of data to train or fine-tune AI models will be disclosed here and will not occur without appropriate legal basis.

6. Data Retention

We retain personal information for as long as your account is active and as needed to provide the Services, and thereafter for as long as required to meet legal, regulatory, tax, accounting, or reporting obligations, or to resolve disputes.

7. Your Rights

Subject to applicable law, you have the right to:

  • Access the personal data we hold about you;

  • Correct inaccurate or incomplete data;

  • Withdraw consent to processing, or request erasure of your data, subject to our legal and record-keeping obligations;

  • Nominate another individual to exercise your rights on your behalf in the event of death or incapacity (as provided under the DPDP Act); and

  • Lodge a grievance with our Grievance Officer (Section 11) and, if unresolved, with the applicable data protection authority.

8. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor security review. No system is completely secure, and we cannot guarantee absolute security of information transmitted to or stored by the Services.

9. Children's Privacy

The Services are intended for use by adults seeking or providing fertility care and are not directed to individuals under 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us so we can delete it.

11. Changes to This Policy
